AI is already embedded across clinical documentation, diagnostics, scheduling, revenue cycle management and patient communications. It touches decisions that carry real consequences. AI tools were quickly adopted to reduce documentation burden, improve workflow efficiency, and manage growing volumes of data. In practice, this meant AI was directly introduced into the everyday systems that clinicians already use. Adoption did not wait for governance frameworks to mature.
But that experience exposed a gap. While traditional governance models assumed technology deployment could be reviewed, approved, and monitored at a measured pace, AI did not behave that way. A recent class action lawsuit alleges that Sharp HealthCare used an AI-embedded “ambient clinical documentation” tool to record doctor-patient conversations without obtaining proper consent, and then inaccurately documented that patients had been advised of and consented to the recording when they had not.
The lawsuit isn’t framed as a clinician misconduct case but as a privacy and consent issue, which implies that the problem lies in the organizational deployment and communication of AI use. When health care organizations don’t know how or when AI is being used, the people on the other side, such as patients, cannot be properly informed. Disclosure becomes inconsistent or incomplete, not because of intent, but because leadership itself lacks clarity.
Transparency cannot be treated as patient-facing alone. It has to start at the organizational level. Health care organizations have learned that they need a clear understanding of which systems use AI, how those systems influence documentation or decision-making, and where human judgment remains in control.
This lesson is one of the most important ones health care offers to other industries. Organizations must understand how AI is being used, who is using it, and when. If they do not understand their own AI use, they cannot expect trust from the people they serve.
When governance follows reality
Health care did not arrive at these lessons by design. It arrived at them because AI adoption moved faster than governance, and the consequences left gaps that were impossible to ignore.
That experience matters beyond health care. AI is already embedded in financial systems, legal platforms, education tools, and customer-facing services. In each case, the same pressures will emerge: visibility gaps, accountability questions, and trust challenges.
